Terms and Conditions

The Subway® platters online ordering service which is administered by Altaine Ltd and accessed via www.subwayfresh2u.co.uk is subject to registration and the following terms and conditions. These terms and conditions will come into effect when you register with us. All Subway® stores are independently owned and operated by franchisees.

1 Registration

1.1  You are registering as a user of www.subwayfresh2u.co.uk. Access is via your user name and password, which is personal to you. You must therefore not allow your user name and password to be used by anyone else, and must not permit or assist anyone who is not a registered user to gain access to any part of www.subwayfresh2u.co.uk. You must also immediately notify the system administrator if a third party obtains your user name and/or password or email address by sending an email to info@subwayfresh2u.co.uk. You can change your password at anytime by clicking the "Change my Password” button on the ‘My Details’ page.

2 Making a purchase

2.1 To make a purchase, simply browse www.subwayfresh2u.co.uk, click on any items that you wish to add to your order. After you have finished your selection, please click on "Finish" and you will be asked for a few details including which store you would like to prepare your order.

2.2 All orders require a lead time and the lead time varies depending on whether the order is for collection or delivery and what time of day it is required. Lead time details are shown on the Welcome page as well as on the ordering pages themselves. The system will not allow you to select pick-up or delivery times outside the required lead times. Order cancellations can be made online by 5pm the day before the delivery date. Same day cancellations are not accepted.

3 Price and Payment

3.1 As each Subway® store is independently owned and operated, prices and payment options may vary from store to store. The price you pay will be clearly indicated as you progress through your order and a final total will be confirmed prior to submitting payment details. All stores offer a Cash on Delivery/Collection payment option and many will also offer credit card and House Account payment facilities.

3.2 Participating stores are not obliged to offer House Account payment facilities. Customer applications for House Accounts are submitted and processed online. An email will be automatically sent within 48 hours of receiving the House Account application advising you whether or not the application was accepted or declined. The individual Subway® store reserves the right in its sole discretion to accept or decline any House Account application and to terminate any such account at any time and need not give any reason for any such decision. Payment terms for House Accounts are strictly 30 days from date of invoice. Invoices are sent on the 8th day of the month following the period. The credit limit for all House Accounts is £750.00.

3.3 Participating stores are not obliged to offer credit card payment facilities. Those that do, accept payment on-line by most leading credit and debit cards including Visa, MasterCard, JCB, Maestro and Delta. Payment will be charged against your card at the time of order.

3.4 Price and availability information is subject to change without notice.

4 Delivery

4.1 Products will be delivered to the delivery address nominated by you at the time of making the order. Customers may change their nominated delivery address during the order process but not after confirming their order.

4.2 All deliveries must be checked and signed for by an approved representative of the customer at the time of delivery. Signature will be deemed to constitute acceptance of delivery of a complete order.

4.3 If any part of an order is found to be missing (or is rejected) on delivery, the customer must inform the system administrator immediately by calling the help-line on 0-800-014-8170.

5 Collection

5.1 Products may also be collected from your nominated store, rather than being delivered to you. You may collect your order from the store nominated by yourself at the time of making the order. Customers may NOT change their nominated store once an order has been placed and accepted by the store.

5.2 All collections must be signed for by an approved representative of the customer at the time of collection. Signature will be deemed to constitute acceptance of a complete order.

5.3 If any part of an order is found to be missing (or is rejected) on collection, the customer must inform the system administrator immediately by calling the help-line on 0-800-014-8170.

6 Terms of Supply

6.1 Food supplied by participating Subway® stores is strictly for direct consumption.

6.2 Risk related to change of product quality due to storage shall pass to the customer on delivery.

7 Liability

7.1 The liability of any Subway® stores in contract, tort (including, without limitation, negligence) or otherwise in respect of any products delivered or otherwise in connection with an order or for any loss, injury or damage attributable directly or indirectly thereto will at the sole option of the supplying Subway® store, be limited to: (a) delivering replacement products (at the supplying Subway® store's expense); or (b) refunding any sums paid to the supplying Subway® store for the products.

7.2 Neither the Subway® store, Doctor's Associates Inc., Subway International B.V. or Altaine Ltd will be liable (whether or not caused by negligence) for any loss of profit or goodwill or opportunity or reputation suffered or incurred by any third party, nor for any indirect or consequential loss.

7.3 Neither the Subway® store, Doctor's Associates Inc., Subway International B.V. or Altaine Ltd will be liable for any loss, injury or damage attributable directly or indirectly to any use of or inability to use the www.subwayfresh2u.co.uk website by you including (but not by way of limitation) any inaccessibility or malfunctioning of the website or any viruses passed to your computer from the www.subwayfresh2u.co.uk website. 

8 Termination

Altaine Ltd reserves the right to terminate your access to www.subwayfresh2u.co.uk immediately without notifying you in advance should you not operate your account in line with these terms and conditions.

9 Use of material appearing on the www.subwayfresh2u.co.uk site

All rights in the site design, computer codes, text, graphics and other content, interfaces, and the selection and arrangements thereof (the "Materials") belong to Doctor's Associates Inc. Any use (including without limitation any further reproduction, storage or transmission to anyone) of any Materials without prior written permission is strictly prohibited.

11 Variation

11.1 Altaine Ltd reserves the right to amend the terms of this Agreement from time to time. Your continued use of any part of the www.subwayfresh2u.co.uk site after any such amendment will constitute your acceptance of the amendment or amendments concerned. You should therefore regularly visit these terms and conditions to ensure that you keep up to date with your rights and obligations under this Agreement. If any such amendments are considered in the reasonable opinion of Altaine Ltd to be material, notice of the amendments will be emailed to all registered users of www.subwayfresh2u.co.uk at their registered email address.

11.2 If you do not wish to accept an amendment you should immediately withdraw your registration to the www.subwayfresh2u.co.uk site.

12 Access/Force Majeure

12.1 Although Altaine Ltd will aim to provide uninterrupted access to the www.subwayfresh2u.co.uk site, Altaine Ltd cannot guarantee this. Altaine Ltd accepts no responsibility or liability for any interruption or delay which may occur to anyone visiting or wishing to visit the www.subwayfresh2u.co.uk site.

12.2 In the event the Subway® store, Doctor's Associates Inc. or Altaine Ltd cannot fulfil obligations to you under this agreement due to any event beyond reasonable control, you will be notified and all relevant parties will be relieved of any obligations to you under these terms and conditions to the extent such performance is hindered by such an event.

13 Jurisdiction

This Agreement is governed by English law and you agree to submit to the exclusive jurisdiction of the English courts.
